1. Introduction

Welcome to Companion!

We're glad to have you with us. Please take a moment to read through this document, as it outlines important information about using Companion safely and responsibly.

Companion is an AI platform, chat service built to encourage self-reflection through empathetic and pragmatic discussions ("Companion"). While using advanced AI technology, it's designed to empower humans for more fulfilling lives by helping you track thoughts, insights, and emotions over time in a supportive, accessible environment available 24/7.

These Terms of Service ("Agreement") govern your use and access of Companion offered through our website www.com2.ai and its subdomains (the "Website").

The terms "us" or "we" refers to Com2.ai AS (business registration number: 935 872 847; seat: Sjolivegen 256, 2677, Nedre Heidal, Norway), the company who designed and built Companion.

This Agreement may be updated from time to time, and the latest version will always apply. It is your responsibility to periodically review the Website to ensure your awareness of the latest Terms. If you do not agree to any change, you must discontinue your access and use of Companion immediately.

By choosing a subscription, or clicking "Start Free Trial!" or otherwise using Companion, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, please do not use Companion.

Important eligibility notice

You may only use Companion if you:

• are at least 18 years old; or
• are at least the minimum age at which you can lawfully consent to the use of online services in your country of residence (for example, 13 in some countries and 16 in others), and you have any parental or guardian consent that is required under local law; and
• are not prohibited from using Companion under any applicable laws.

Use by minors

If you are under 18, you may only use Companion where this is permitted by the laws of your country and only:

• if you are at least the minimum digital consent age under local data-protection law (for example, GDPR Article 8 in the EEA), and
• where required, your parent or legal guardian has reviewed these Terms and our Privacy Policy and has given consent to your use of Companion and to our processing of your personal data.

2. Our Services

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Companion is an AI-powered personal chatbot service designed to support mental well-being by fostering meaningful self-reflection, emotional awareness, and personal growth. Built with empathy, accessibility, and privacy at its core, Companion provides users with a safe, stigma-free, and anonymous environment where they can explore their thoughts and emotions at their own pace.

At the heart of the service is a private, encrypted diary that allows users to document and track emotional patterns over time. Through intuitive and culturally sensitive conversations, Companion offers reflective questions and evidence-based emotional intelligence strategies that gently guide users toward greater self-understanding, inner stillness, and more authentic connections.

While not a substitute for therapy, Companion acts as a compassionate mirror, helping people surface hidden emotional burdens and rediscover balance in their daily lives. Companion is intended and made available for personal, non-commercial use only.

3. Disclaimers

3.1 Medical Disclaimer

Companion is an AI-powered personal chatbot designed solely to support mental well-being by fostering self-reflection, emotional awareness, and personal growth. Companion does not provide medical advice, diagnosis, cure or treatment, does not prevent any medical or psychological condition, and is not classified as a medical device under applicable law. Interactions with Companion do not establish a therapeutic relationship and should never be considered a substitute for consultation with licensed mental health professionals, physicians, or emergency services.

All content, conversations, prompts, and diary features offered within Companion are generated and processed by artificial intelligence and are intended solely for informational and supportive, wellness and self-development purposes. While Companion strives to provide evidence-based emotional intelligence strategies in a stigma-free and secure environment, outcomes may vary, and users remain responsible for verifying any information that may relate to their health or mental state.

If you are experiencing severe distress, mental health crisis, suicidal thoughts, or symptoms that may require medical attention, please seek immediate support from a qualified healthcare provider or contact local emergency services.

By using Companion, you acknowledge and agree that:

• Companion is for self-reflection and wellness only, not for medical or therapeutic use.
• Any insights or reflections offered by the AI are general in nature and should not be relied upon as health or medical advice.
• You remain fully responsible for your own health decisions and for seeking professional care when needed.

Companion complies with applicable legal frameworks, including the EU AI Act's transparency requirements, by clearly informing users that they are interacting with an AI system. When using Companion, you are interacting with an artificial intelligence system, not a human being. Human oversight is integrated to help ensure safety and quality, but Companion should always be understood as a supportive tool, not a replacement for human care.

Companion is an artificial intelligence designed to simulate human-like interactions, but Companion does not possess genuine emotions, intentions, and does not have the ability to fulfill promises in the real world. Any elements within the conversations that may resemble reality are entirely simulated and should not be taken seriously.

Therefore, if you notice that your use of Companion is leading to signs of over-reliance, addiction, withdrawal from real-life human connections, or the development of private, intimate feelings toward Companion, we strongly recommend that you pause your use and, if needed, seek guidance from a licensed therapist or other qualified professional.

3.2 Disclaimer of Warranties and Liability

Companion is provided on an "as is" and "as available" basis. While we aim to offer a reliable and supportive service, we cannot guarantee that Companion will meet your specific expectations or requirements; will be uninterrupted, timely, secure, or error-free; or that any Output generated by Companion will be accurate, complete, or suitable for your particular purposes.

To the maximum extent permitted by law, Com2.ai AS shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Com2.ai's total cumulative liability to you for all claims shall not exceed the greater of (a) the amount you paid for Companion in the six (6) months prior to the event giving rise to liability, or (b) 1000 NOK.

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; gross negligence or willful misconduct; or any other liability that cannot be excluded or limited under mandatory EU/EEA law.

You remain solely responsible for the correctness, quality, and lawful use of your input, and for any decisions made or actions taken based on outputs from Companion.

4. Subscriptions

4.1 Subscription Plans

Some services may be available only for paid subscribers. The subscription will begin after the initial payment, and the payment should be made pursuant to the terms presented at the time of the purchase. You are responsible for payment of all fees, charges and taxes (as applicable) related to the transaction.

4.2 Registration, Eligibility and Age Limits

4.2.1 Intended User Groups and Age Limits

Companion is primarily designed for users who are 18 years of age or older. In some jurisdictions, Companion may be made available to users aged 16-17, or in limited cases to users aged 13-15, subject to additional safeguards. These safeguards may include, where required by applicable law, verified consent from a parent or legal guardian and/or restricted access to certain features.

Companion is not intended for, and must not be used by, any person who is below the minimum age at which they can lawfully consent to the use of online services and to the processing of their personal data in their country of residence.

4.2.2 Registration and Account Information

When you choose a subscription plan or try out the Free Plan, you will be required to register for Companion, where you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the registration forms. You are fully responsible for all activities occurring under your login credentials and account.

Companion and Com2.ai AS processes personal data solely in accordance with the General Data Protection Regulation (GDPR) and other applicable EU and EEA data protection laws. Registration data and certain other information about you are governed by our Privacy Policy.

4.2.3 Security and Use of Your Account

Once registered, you are responsible for maintaining the confidentiality of your password and account, and are fully responsible for any and all activities that occur under your password or account. In using Companion, you should not disclose sensitive personal information, including financial details, addresses, contact information, health information, or passwords.

You agree to immediately notify Com2.ai AS of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session when accessing Companion. Com2.ai AS will not be liable for any loss or damage arising from your failure to comply with this section.

4.2.4 Non-Transferability of Subscriptions

Companion subscriptions are not transferable and therefore cannot be sold or exchanged or transferred in any way whatsoever, for commercial purposes or free of charge. You may not assign all or any part of this Agreement or your rights under this Agreement without Com2.ai AS's prior consent. You are solely responsible for any and all activities that occur in relation to your account.

4.2.5 Acceptable Use and Geo-Restrictions

You shall not use Companion to upload, transmit, or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, threatening, pornographic, obscene, containing viruses, or is otherwise objectionable. Personal attacks, defamation, harassment, spam, offensive content, or other illegal activities are strictly prohibited.

Com2.ai AS reserves the right to refuse or deny registration of an account at any time and without notice for any reason. Access to Companion may be restricted or unavailable in certain jurisdictions due to local laws, regulatory requirements, or business considerations.

4.3 Fees

The cost of the subscription plan is available on the official website. The latest subscription pricing and program details available on the official website shall be considered the valid and binding information.

4.3.1 Annual Plan

By subscribing to the Annual Plan, you enter into a binding one-year subscription contract starting from the date of purchase. EU residents are entitled to a 14-day right of withdrawal from the date of conclusion of the contract. If you exercise this right within 14 days, we will refund your payment in full. After this 14-day period, the sale is final and no refunds will be issued. Unless you cancel the Annual Plan before the renewal date, the subscription will automatically renew for an additional one-year term on the same conditions.

4.3.2 Monthly Plan

By subscribing to the Monthly Plan, you enter into a binding one-month subscription contract. EU residents are entitled to a 14-day right of withdrawal. After this 14-day period, the sale is final and no refunds will be issued. Unless you cancel the Monthly Plan before the renewal date, the subscription will automatically renew for an additional one-month term.

4.3.3 Free Plan and Free Trial

By subscribing to the Free Plan, you enter into a 14-day free trial period starting from the date of activation. During this Free Trial, you will have access to all features available in the Pro version of Companion. At the end of the 14-day Free Trial, your access to Companion will expire unless you actively subscribe to a paid plan. If you do not subscribe, your account will be closed and all personal data and content will be permanently deleted, except for data we are legally required to retain. This deletion is irreversible.

4.3.4 Pricing Modifications

Subscription fees may be adjusted automatically in line with the official rate of inflation (Konsumprisindeksen, KPI) published by Statistics Norway (SSB). In addition, Com2.ai AS may increase subscription fees for future periods with at least one (1) month's advance notice. Users have the right to object within seven (7) days of receiving the notice. Failure to object within this period will be deemed acceptance of the new service fee.

4.3.5 Common Provisions

Sales are final and we will not provide a refund, except where required by mandatory consumer protection law. You accept responsibility for all recurring charges prior to cancellation. You must cancel your subscription before it renews each billing period in order to avoid billing of the next subscription fee. Refunds cannot be claimed for any partial-month subscription period.

You are solely responsible for all applicable sales taxes, VAT taxes, and all other assessments that may apply at any time to your use of Companion. If Com2.ai AS extends any credit terms to you and you fail to pay as agreed, you shall also be responsible for a late fee of ten percent (10%) of the outstanding balance, default interest at twice the prevailing Norwegian Central Bank base rate, and documented collection-related costs.

5. Cancellation of Services

5.1 Cancellation by You

You may cancel your subscription at any time by deleting your account. Deleting your account is a permanent and irreversible action. All personal data and content will be permanently erased, except for data that we are legally required to retain for billing, tax, or contractual compliance purposes.

You may also cancel by cancelling automatic renewal. Your current subscription will remain active until the end of the already paid billing period.

5.2 Cancellation by Us

We may suspend or terminate your account at any time if we have reason to believe that you have violated the Agreement, our other Policies, or applicable law. In such cases, we will act fairly and proportionately, and where reasonably possible, provide notice before suspension or termination.

Com2.ai AS also reserves the right to discontinue Companion or the Website, in whole or in part, at any time and with immediate effect. In such cases, users who have pre-paid subscription fees will receive a proportional refund corresponding to the unused portion of their current billing period.

5.3 Content Moderation and Removal

Com2.ai AS has implemented content moderation measures based on proprietary large language model (LLM) technology to help ensure compliance with this Agreement. If our automated systems detect content that may violate these rules, it may be subject to moderation. Manual review will only take place where necessary to ensure safety, legal compliance, or enforcement of the Agreement.

Repeated or serious violations of this Agreement may result in account restrictions, suspension, or termination. For the purpose of enforcement, "repeated violations" means three (3) violations within one week, five (5) violations within one month, or more than ten (10) violations within any twelve-month period. Users are not entitled to refunds for moderation actions taken in response to violations.

6. User Conduct

6.1 Conditions of Use

You are solely responsible for the text, messages, reflections, or other information ("content") that you input into Companion. You agree not to use Companion to submit or share any content that is unlawful, harmful, abusive, harassing, defamatory, obscene, invasive of another's privacy, infringing on intellectual property rights, or otherwise in violation of applicable law or our Policies.

6.2 Restrictions on Use

You must be a human to use Companion. Automated account registration or automating functions of Companion are strictly prohibited. You agree not to use Companion for any unlawful, harmful, or inappropriate purpose, including but not limited to:

• Uploading or sharing content that infringes intellectual property or other proprietary rights, contains viruses or malware, constitutes spam or unauthorized advertising, or is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Interfering with or disrupting Companion or the servers or networks connected to it.
• Deciphering, decompiling, disassembling, or reverse-engineering the software or materials comprising Companion.
• Violating any applicable law or regulation, whether local, national, or international.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Soliciting or attempting to solicit personal information from anyone under the age of 18.
• Misusing Companion as a substitute for professional medical, mental health, legal, or financial advice.
• Using Companion for prohibited or high-risk purposes under the EU AI Act, including biometric surveillance, social scoring, or manipulative exploitation of vulnerabilities.
• Misrepresenting outputs generated by Companion as human-created in contexts where transparency is legally required or materially relevant.

6.3 Incidents and User Actions

Com2.ai AS shall not be held responsible for any actions, decisions, or consequences arising from a user's engagement with Companion, including but not limited to psychological distress, reliance on outputs, or harmful behaviours. We do not accept liability for incidents of self-harm, suicidal ideation, or actions taken by users as a result of their interactions with Companion.

If you are experiencing thoughts of self-harm, suicide, or other acute distress, you must immediately discontinue use of Companion and contact local emergency services or a qualified mental health professional.

7. Data Storage and Portability

You acknowledge that Companion is not intended for permanent storage and agree not to use Companion for archiving data or for back-up purposes. You agree that Com2.ai AS has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the user.

We reserve the right to terminate accounts that are inactive for an extended period of time. For the purposes of this Agreement, inactivity means no login or use of Companion for more than two (2) years in the case of an Annual Plan, or six (6) months in the case of a Monthly Plan.

Before terminating an account, users will receive advance notice. During this notice period, users may exercise their statutory right to data portability (GDPR). This includes the right to obtain all personal data provided to Companion, as well as personal data generated through their interactions, such as conversational inputs, diary entries, summaries, metadata, and other outputs directly linked to the user. Data will be made available in a structured, commonly used, and machine-readable format.

All data portability requests must be made within seven (7) business days from the date of notification. After this period, the account and all associated personal data will be permanently deleted, except for data that Com2.ai AS is legally required to retain.

8. Data Processing

Com2.ai AS will use commercially reasonable efforts to maintain appropriate administrative, physical, and technical safeguards designed to protect the security, confidentiality, and integrity of your personal data. Data processing will be carried out strictly in accordance with the GDPR, the Norwegian Personal Data Act, and other applicable EU/EEA data protection laws.

Personal data processed through Companion may include conversational inputs, diary entries, and related metadata you provide in the course of using Companion. This data is encrypted, stored securely in the EU/EEA, and handled only for purposes necessary to provide and operate the service, ensure security and compliance, maintain and improve functionality, and comply with applicable legal obligations.

Com2.ai AS does not sell personal data, nor does it use personal data for purposes incompatible with those described in our Privacy Policy.

As a data subject under GDPR, you retain all rights including the right to access, rectification, erasure, restriction, objection, and data portability. Requests to exercise these rights may be submitted at any time by contacting us by email.

9. Intellectual Property Rights

9.1 Ownership of Content, Software, and Trademarks

All rights, title, and interest in and to Companion and the Website, including but not limited to software, source code, algorithms, designs, user interfaces, text, graphics, images, audio, video, logos, trade names, service marks, and trademarks (collectively, "Service Content") are owned by or licensed to Com2.ai AS.

Except as expressly permitted in this Agreement, you may not copy, reproduce, modify, distribute, frame, scrape, rent, lease, loan, sell, sublicense, transfer, display, create derivative works of, reverse engineer, decompile, disassemble, or otherwise attempt to exploit any part of the Service Content. The "Companion" name, brand, and logos are trademarks of Com2.ai AS.

9.2 Third-Party Materials

Companion and the Website may contain content, links, or features provided by third parties. All rights in such third-party materials belong to their respective owners. The presence of such content or links does not constitute an endorsement by Com2.ai AS. Your access to and use of third-party materials is entirely at your own risk.

9.3 User Content: Inputs and Outputs

You may provide conversational inputs, messages, diary entries, or other text ("Input") to Companion and receive responses or generated material ("Output") from Companion. You retain ownership of your intellectual property rights in the Input you provide.

By submitting Input, you grant Com2.ai AS a non-exclusive, worldwide, royalty-free license to use, reproduce, process, store, and display the Input and related Output strictly as necessary to provide and operate Companion, ensure compliance with this Agreement and applicable law, and develop, improve, and maintain Companion. Outputs will not be used for marketing or external publication in a way that identifies you personally, unless we have obtained your explicit consent.

9.4 Copyright Complaints

If you believe that material available through Companion infringes your copyright or other intellectual property rights, you may submit a notification to our email address with your contact details, a description of the copyrighted work, a description of where the allegedly infringing material is located, a statement of good faith belief that the use is unauthorized, and a statement made under penalty of perjury that the information is accurate and that you are the rights holder or authorized to act on their behalf.

9.5 Repeat Infringer Policy

In accordance with applicable EU and EEA law, Com2.ai AS will terminate accounts of users who are determined to be repeat infringers of intellectual property rights.

10. General Conditions

10.1 Entire Agreement

This Agreement, together with any other documents or policies expressly incorporated by reference, constitutes the entire agreement between you and Com2.ai AS regarding your use of Companion and the Website.

10.2 Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid, binding, and enforceable to the fullest extent permitted by law.

10.3 No Waiver

The failure of Com2.ai AS to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

10.4 Assignment

Com2.ai AS may assign, transfer, or delegate its rights and obligations under this Agreement without prior notice or consent. You may not assign or transfer your rights or obligations under this Agreement to any third party without the prior written consent of Com2.ai AS.

10.5 Force Majeure

Com2.ai AS shall not be held liable for any failure or delay in performance caused by events outside its reasonable control, including but not limited to natural disasters, acts of war or terrorism, government actions or restrictions, cyberattacks, pandemics, or failures of telecommunications or internet services.

10.6 Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Norway, without regard to conflict-of-law principles. All disputes shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway, unless mandatory EU/EEA consumer protection laws entitle you to bring or defend legal proceedings in the courts of your country of residence.

10.7 Survival

Provisions of this Agreement that by their nature should survive termination shall continue in effect after termination of your account or this Agreement, including but not limited to sections on Intellectual Property, Data Processing, Limitation of Liability, and Governing Law.
